Terms of Use

This is a legal agreement between the person or organization (“User” or “you”) agreeing to these Terms of Service (“Terms”) and DEAL N SUM, LLC, a Florida limited liability company (“Deal N Sum,” “us,” or “we”), for the use of the Deal N Sum mobile application(s) (singularly and collectively hereinafter referred to as “Application”) and related services (“Services”) available on our Website (as defined below). By accepting these Terms or using the Application or Services, you represent that you are of legal age and have the authority to bind the User to these Terms, Deal N Sum’s Privacy Policy, and the applicable conditions set forth herein (collectively the “Agreement”).

Users are responsible for reviewing the terms and conditions as posted on the Deal N Sum website located at https://dealnsum.com (the “Website”). Use of the Website, Application, and Services constitutes your agreement to the Agreement. Deal N Sum reserves the right to change the terms, conditions, and notices of this Agreement. You are responsible for regularly reviewing these terms and conditions and additional terms posted on the Website or provided to you via electronic mail. Continued use of the Website, Application, and Services constitutes your agreement with all such new or revised terms, conditions, and notices.

    By accessing the Website or using the Application and Services, you are agreeing to be bound by all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws governing the use of the Website, Application, and Services. The materials contained in the Website are protected by applicable copyright and trademark laws.

    • Permission is granted to download one copy of each individual or distinct Application from the Website or applicable “App Store” for personal, non-commercial use only (the “License”). This is the grant of a license, not a transfer of title, and under this license you may not:

      • attempt to decompile or reverse engineer the Application
      • remove any copyright, trademark, or other proprietary notations from the Application or

    • This License shall automatically terminate if you violate any of the aforementioned restrictions and may be terminated by Deal N Sum at any time. Upon terminating your use of the Application or upon the termination of the License, you must destroy any downloaded copies of the Application in your possession, whether in electronic or printed format.

    The Application and Services are provided “as is”. Deal N Sum makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties. Further, Deal N Sum does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the Application and Services or software and devices related to the use of the Application, Services, or any other websites linked to the Website.

  • 4. Limitations

    In no event shall Deal N Sum or its affiliates be liable for any damages (including, without limitation, damages for loss of data, profit, or due to business interruption) arising out of the use or inability to use the Website, Application, or Services. Because some jurisdictions do not allow limitations on implied warranties or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

    Deal N Sum has not reviewed any websites linked from the Website and therefore Deal N Sum is not responsible for the contents of any such linked website. The inclusion of any website link on the Website does not imply endorsement by Deal N Sum of that particular linked website. Use of any such linked website is at the User’s own risk.

    As a condition of your use of Website, Application, or Services, you agree not to use the Website, Application, or Services for any purpose that is unlawful or prohibited by this Agreement. Any claim relating to this Agreement, the Website, Application, or Services shall be governed by the laws of the State of Florida.
